01

Situation

A non-profit organization with close ties to a municipality operated through a separate legal entity. Because of that structure, it did not automatically benefit from the rebate regime generally available to municipalities.

02

Issue

The question was whether the organization’s activities, the functions it performed, its legal framework and the nature of its municipal ties supported recognition as a municipality for GST and QST purposes. That status could provide access to a more favourable rebate regime and durably reduce the tax cost of its expenses.

03

Support provided

Alexandre reviewed the organization’s activities, legal structure, governance and overall relationship with the municipality. After concluding that the applicable conditions were met, he prepared and submitted the requests required for the organization to be recognized as a municipality for GST and QST purposes.

04

Result

The recognition extended the municipal tax benefits to the organization and substantially reduced the GST and QST cost of its eligible expenses.

CPA-firm takeaway

An organization does not necessarily have to be created by a municipality or have the municipality as a member for this possibility to merit review. Its activities, the functions it performs and its various relationships with a municipality or local government can be determinative. A complete analysis may reveal access to a materially more favourable rebate regime.
